These Terms & Conditions ("Terms") govern access to and use of QR398 (the "Service"), a digital QR-code menu platform for restaurants, cafes, and other food businesses. By creating an account or otherwise using the Service, you ("you", "the account holder", or "the Restaurant") agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. The Service
QR398 allows a registered business to build and host a digital menu, generate a scannable QR code linking to that menu, customize its appearance, and view basic analytics. Customers viewing a restaurant's menu through QR398 are not required to create an account and do not interact with QR398 as registered users.
2. Account Responsibilities
- You must provide accurate, current information when creating your account, including a valid business name, email address, and phone number.
- You are responsible for keeping your login password confidential and for all activity that occurs under your account, whether or not you personally performed it. You can change your password at any time from Settings → Security.
- You must notify us promptly if you believe your account has been accessed without your authorization.
- You are solely responsible for the accuracy of the menu content you publish, including dish names, descriptions, prices, and images — including ensuring pricing shown to customers is correct and current.
- You must be legally authorized to represent the business you register, and must only upload images and content you own or have the right to use.
- Staff accounts (Pro plan): if you create Manager, Waiter, or Kitchen Staff logins for your team, you are responsible for those accounts' credentials and activity in the same way you are responsible for your own — each staff account is scoped to your restaurant only and cannot access any other restaurant's data on the platform.
- Order notes, special instructions, GSTIN, and billing (GST/Service Charge) settings you configure are your responsibility to keep accurate — QR398 displays these values as entered and does not verify their correctness.
3. Plans, Subscription & Billing
QR398 is offered on two subscription tiers, described further in Section 3A below:
- Starter — a digital QR menu with unlimited categories and dishes, branding (logo, banner, colors, dish fonts), multi-language menu, and QR scan analytics.
- Pro — everything in Starter, plus table-wise Dine-In and Takeaway ordering, the Kitchen Display System (KDS), staff roles (Manager/Waiter/Kitchen Staff), Waiter Call & Bill Request, Table Status Management, Order Handling Modes, full revenue analytics and menu insights, and Reports with PDF/Excel export.
- New accounts receive a 7-day free trial with full (Pro-equivalent) access to the Service, no payment required to begin.
- After the trial period ends, continued access requires an active paid subscription on either the Starter or Pro plan, billed on a monthly, quarterly, or annual cycle. Current pricing for each plan/cycle combination is shown on the pricing page and at checkout, and may be updated by us from time to time (see below).
- Payment is currently collected manually via UPI. You submit a transaction reference (UTR) after sending payment, and an administrator reviews and approves it before your subscription is activated. Approval is not instantaneous and may take some time.
- Subscriptions do not automatically renew through any stored payment method, since no card or bank details are collected or stored by QR398 — you submit a new payment and reference at the end of each billing cycle to continue access.
- A Starter subscription may be upgraded to Pro at any time; the upgrade takes effect immediately upon approval, and the amount payable is prorated based on the time remaining in your current billing cycle (see Section 3A). A Pro subscription may be downgraded to Starter, which takes effect at your next renewal rather than immediately, so you retain full Pro access for the remainder of the period you've already paid for.
- If your subscription lapses, your menu and QR code will stop being accessible to customers until payment is submitted and approved again. Your account, settings, and menu data are preserved and are not deleted simply because a payment is late, unless you delete your account yourself.
- We reserve the right to change subscription pricing going forward, with reasonable notice provided to existing account holders before any change takes effect for them.
3A. Upgrades, Downgrades & Proration
- Upgrading from Starter to Pro mid-cycle is charged only for the remaining value of your current billing cycle, calculated as the prorated cost of Pro for your remaining days minus the prorated value of Starter for the same days. This amount is calculated automatically and shown to you before you submit payment.
- Scheduling a downgrade from Pro to Starter does not interrupt or reduce your current period of Pro access — it simply changes what plan is applied starting at your next renewal. A scheduled downgrade can be cancelled at any time before that renewal.
4. Prohibited Activities
You agree not to do any of the following while using QR398:
- Attempt to access, modify, or interfere with another restaurant's account, menu, or data.
- Upload content that is unlawful, fraudulent, sexually explicit, defamatory, or that infringes someone else's intellectual property or trademark rights.
- Attempt to bypass, disable, or interfere with any security feature of the Service, including rate limits, login protections, or access controls.
- Use automated tools (bots, scripts) to create accounts, scrape data, or artificially inflate menu view counts.
- Use the Service to collect personal information about customers beyond what the Service itself is designed to do.
- Resell, sublicense, or white-label the Service without our prior written agreement.
- Reverse-engineer, decompile, or attempt to extract the underlying source code of the Service.
We reserve the right to suspend or terminate any account found to be engaged in prohibited activity, with or without prior notice, depending on severity.
5. Intellectual Property — All Rights Reserved
The QR398 name, logo, platform design, underlying software, and all associated branding are the property of QR398 and its operators. All rights not expressly granted to you under these Terms are reserved. Your subscription grants you a limited, non-exclusive, non-transferable right to use the Service to operate your own digital menu — it does not transfer ownership of any part of the Service itself to you.
You retain ownership of the content you upload (your menu text, prices, and images). By uploading content, you grant QR398 a limited license to host, store, and display that content solely for the purpose of operating the Service on your behalf.
6. Service Availability
We aim to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may occasionally be unavailable for maintenance, updates, or due to circumstances outside our reasonable control, including outages at our hosting or infrastructure providers.
7. Limitation of Liability
This section limits what QR398 can be held responsible for. Please read it carefully — by using the Service, you agree to these limits.
- The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, or non-infringement.
- QR398 is not liable for any indirect, incidental, special, or consequential damages — including loss of revenue, loss of customers, or loss of business opportunity — arising from your use of, or inability to use, the Service.
- QR398 is not responsible for the accuracy of menu content, pricing, or dietary/allergen information that you, the account holder, enter and publish. You are solely responsible for the accuracy of what is shown to your customers.
- QR398 is not responsible for any loss, damage, or claim arising from a third party scanning, copying, or misusing a printed QR code outside of our platform's control — for example, if a QR code sticker is tampered with or replaced at your premises.
- To the maximum extent permitted by applicable law, QR398's total liability for any claim arising from these Terms or use of the Service is limited to the amount you paid us in subscription fees in the three (3) months immediately preceding the event giving rise to the claim.
- Nothing in these Terms limits liability for fraud, gross negligence, or any liability that cannot be excluded under applicable law.
8. Account Suspension & Termination
We may suspend or terminate access to your account if you violate these Terms, fail to maintain an active subscription beyond a reasonable grace period, or if required to do so by law. You may delete your own account at any time from your dashboard settings; doing so permanently removes your menu, dishes, images, analytics, and payment history, and cannot be undone.
9. Changes to These Terms
We may update these Terms from time to time as the Service evolves. Material changes will be reflected by updating the "Last updated" date above. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
10. Governing Law
These Terms are governed by the laws of India, without regard to conflict-of-law principles. Any disputes arising under these Terms shall be subject to the jurisdiction of the courts located in India.
